Terms of business
QUOTATIONS AND PRICES
All prices quoted by the company are provisional and may be subject to change. All customers will be informed of any adjustments prior to the ordering point. All prices are excluding VAT unless stated otherwise.
PAYMENT
Cash Sales. Payment becomes due from the date on the invoice.
CREDIT ACCOUNT
Payment of such invoices should be made no later than the end of the month succeeding the month that such invoices have been raised. If the customer exceeds these credit terms the supply of goods/services will be suspended and the customers account terms will be reviewed.
TITLE OF GOODS
It is a condition of sale that all goods supplied by Alliance Transport Technologies will remain the property of Alliance Transport Technologies and the title of such goods shall not pass to the purchaser until they have been paid for in full. In the event of the purchaser defaulting on payment for any reason including bankruptcy or insolvency, the purchaser will authorise Alliance Transport Technologies to enter the purchasers property where the goods are stored and remove all goods supplied by Alliance Transport Technologies, up to the value of the debt.
Alliance Transport Technologies shall give credit to the purchaser for all the goods repossessed.
DELIVERY OF GOODS
Receipting of delivered goods is the responsibility of the customer. Any shortages, anomalies or damages are to be reported within the first 24 hours at point of delivery. Failure to do so will result any subsequent claims against delivered goods will be rejected.
RECONDITIONED EXCHANGE PRODUCT
To be acceptable for exchange all old units must conform to the following specifications:-
1) Must be a complete unit (not in pieces).
2) Must be the same part number as original unit supplied.
3) Must have not suffered accidental or deliberate damage.
SURCHARGES
A surcharge shall be applied to the exchange product if old units are not returned at the time of sale. See a current price list for surcharge rates. Old units must be returned within 14 days of the purchase, Alliance Transport Technologies withholds the right to either surcharge you retrospectively or void your warranty should the unit not come back to us.
Warranties
The receipt of information from the purchaser and the delivery by the Company of the goods specified in any order does not in any way imply a warranty that the goods will be suitable for the purposes disclosed. The only warranty which the Company makes in connection with the proprietary good supplied. Alliance Transport Technologies guarantees its reconditioned product against faulty workmanship and components for 12 months. The warranty agreement is between Alliance Transport Technologies and Alliance Transport Technologies customer extending to the end user of the initial sale. If the vehicle that the product is fitted to is subsequently sold, the warranty does not automatically pass to the new owner, to continue the warranty the seller must apply to Alliance Transport Technologies for consideration to transfer the warranty terms to the new owner.
Warranty is conditional on the vehicle being properly serviced according to the vehicle manufacturers recommendations, this includes using both the correct grade and type of oil.
It is important that the failure reason and all underlying issues are resolved before refitting, Alliance Transport Technologies cannot be held responsible for failures caused by external factors.
Warranty may be denied in the event of either the product or the vehicle being modified outside manufacturers specifications.
In the event of any goods proving defective during the period of the warranty due to faulty remanufactured material or workmanship the Company shall, at its option either supply replacement goods or repair such defective goods free of charge, a financial credit is not given where the unit is remanufactured.
We do not offer labour for claims removal and refit onto a vehicle.
Save as provided herein all representations, conditions warranties and terms, whether express or implied by common law statute or otherwise, as to the quality condition or fitness for any purpose of the goods are excluded.
Other product, supplied by Alliance Transport Technologies from other manufacturers will carry the conditions of guarantee as specified by that manufacturers will carry the conditions of guarantee as specified by that manufacturer; available on request.
LIMIT OF LIABILITY
In no event shall the Company be liable for any direct, indirect or consequential loss or damage of any kind howsoever caused arising out of the contract of sale or the use of the goods nor for any diminution in value of components consequent upon or resulting from the use of the Company’s products. Without prejudice to any of the foregoing, the liability arising out of or connected with any order, or manufacture, sale, delivery, resale or use of any goods covered by any such order including but not limited to, loss or liability arising from breach of contract, shall in no case exceed the unit price of such goods or parts thereof involved in the claim. The limit of liability shall not apply to any claim for death or personal injury resulting from the negligence of the Company.
CARRIAGE
Carriage next day and Saturday morning deliveries will be charged according to current rates, unless stated in a formally agreed contract.
